TCEQ Fueling Facility Investigations

Did you know that the TCEQ can charge you up to $10,000 a day for non-compliance? TCEQ was ordered, through the federal Energy Act of 2005, to inspect every underground storage tank site in the state at least once every three years. This includes ANY site that has been registered – unless ALL TANKS at the location have been properly abandoned or removed.

The pace of these inspections is picking up now that TCEQ has contracted with the University of Texas at Arlington (UTA) to perform “modified compliance evaluations” at up to 9,000 sites in the next 18 months. Some of the things UTA inspectors will be reviewing are: inventory control and reconciliation reports, leak detection records, ATG calibration records and cathodic protection test results.

It is important to understand that you ARE going to be inspected. Any violations noted by UTA inspectors will be turned over to your particular TCEQ region. You will then receive a letter from the TCEQ notifying you to correct all deficiencies within 30 days and pay any fines involved. For those who don’t correct all problems within 30 days AND PROVIDE WRITTEN DOCUMENTATION to the TCEQ, enforcement actions will begin.
